1. Who We Are
These Terms of Service (“Terms”) are an agreement between you and CLOUDLINKS SARL (“CloudLinks,” “we,” “us,” or “our”), operating as Cloudlinks ai, based in Beirut, Lebanon. They cover the EXSIR platform (including the AI assistant “Exsir”, shared inbox, chatbots, and campaigns), the StockLens app, cloudlinks.ai, our Meta app “cloudlinks-ai”, and related services (together, the “Services”).
By creating an account or using the Services, you agree to these Terms. If you use the Services on behalf of a business, you confirm that you are authorized to accept these Terms for that business. A separate signed agreement with us, where one exists, takes precedence over these Terms.
2. Accounts
- You must give accurate information and keep it up to date.
- You are responsible for keeping your login details safe and for all activity under your account.
- Tell us promptly at [email protected] if you suspect unauthorized use of your account.
- The Services are intended for businesses and for users aged 18 or over.
3. Acceptable Use
You agree not to use the Services to:
- Break any law or infringe anyone else's rights
- Send spam, unsolicited bulk messages, or messages to people who have not opted in
- Send unlawful, misleading, harmful, or offensive content
- Interfere with, probe, or overload the Services, or try to access them without authorization
- Resell or sublicense the Services without our written permission
If you connect WhatsApp, Facebook, or Instagram accounts, you must follow the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy, the Meta Terms and Community Standards, and any other Meta policies that apply to your use. You must get your customers' opt-in before messaging them where those policies or the law require it, and honor opt-out requests. You are responsible for the content you send through the Services, including content generated by an AI assistant that you configure and approve.
4. Your Data and Privacy
You keep ownership of the data you and your customers put into the Services (“Client Data”). You give us permission to host, process, and transmit Client Data only as needed to provide and support the Services. For the customers who message your business, you are the data controller and we act as your processor. You are responsible for having a lawful basis and any notices or consents required to share that data with us.
Our Privacy Policy explains how we handle personal information, including data received from Meta Platforms. Our User Data Deletion page explains how to disconnect accounts and request deletion.
5. Third-Party Platforms
Some features depend on third-party platforms such as WhatsApp, Facebook, Instagram, app stores, and payment providers. Those platforms are run by third parties under their own terms. We do not control them and cannot guarantee their availability, pricing, approval decisions (for example template or account reviews), or changes to their features. Charges that Meta applies to WhatsApp conversations or messages may be passed on as described in your plan.
6. Fees and Credits
Paid Services are billed according to the plan, prices, and credit allowances you select or agree with us. Credits are consumed as described in your plan. Included credits renew each month and do not roll over; top-up credits you buy do not expire. Refunds, if any, are handled as set out in your plan or agreement with us, or as the law requires. We may change prices for future billing periods with reasonable notice.
7. Suspension and Termination
You may stop using the Services and close your account at any time. We may suspend or end your access if you breach these Terms, fail to pay, put the Services or other users at risk, or if a third-party platform such as Meta requires it. Where reasonable, we will give notice first. After termination, we handle your data as described in the Privacy Policy and the User Data Deletion page.
8. Disclaimers
The Services are provided “as is” and “as available.” To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Services will be uninterrupted or error-free. AI-generated replies can be inaccurate; you should review how your AI assistant is configured and monitor its output.
9. Limitation of Liability
To the extent the law allows, CloudLinks is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim relating to the Services is limited to the amount you paid us for the Services in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
10. Governing Law
These Terms are governed by the laws of Lebanon. Any dispute will be handled by the competent courts of Beirut, Lebanon, unless the law of your country gives you a right to bring proceedings elsewhere.
11. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows the latest revision. We will give notice of material changes in-app or by email where appropriate. Continuing to use the Services after changes take effect means you accept the updated Terms.
